§ 1. GENERAL PROVISIONS
- These Terms and Conditions (hereinafter "Terms") define the rules for concluding sales contracts and the provision of services by FIREPROTECT Sp. z o.o. (hereinafter "the Seller" or "the Service Provider").
- The Terms apply to both Consumers and Business Entities (Entrepreneurs) utilizing the Seller's services.
- The Seller's scope of operations includes, in particular:
- Design, installation, and maintenance of fire protection systems (FAS, SCS, sprinkler systems, hydrants).
- Sale, service, and legalization of portable fire-fighting equipment.
- Fire safety and health & safety (BHP) signage for facilities.
- Specialized training services (Fire Safety, Health & Safety, First Aid, and others).
- Information regarding products and services provided on the website or in catalogs does not constitute an offer within the meaning of Art. 66 of the Polish Civil Code, but an invitation to treat (invitation to conclude a contract).
§ 2. ORDER PLACEMENT AND CONTRACT CONCLUSION
- Orders may be initiated via electronic communication, telephone, or in person at the Seller's registered office.
- Based on the Customer's inquiry, the Seller shall provide a commercial offer (quotation) specifying the scope of work/goods, price, estimated lead time, and the validity period of the offer.
- A contract is deemed concluded upon:
- Written (including e-mail) confirmation of offer acceptance by the Customer without reservations;
- Payment of a deposit or the full amount, if required by the offer terms.
- For training services, the contract is concluded upon submission of a registration form or e-mail confirmation of participation.
- All prices provided by the Seller are gross prices (including VAT) unless the offer explicitly specifies net prices.
§ 3. PAYMENT TERMS
- The primary method of payment is bank transfer to the account: 12 1020 1433 0000 1302 0232 2055.
- The Seller reserves the right to withhold performance of services or delivery of goods until a required deposit or full prepayment is credited to the bank account.
- In B2B transactions, the payment date is defined as the date the Seller's bank account is credited.
- In the event of payment delays, the Seller is entitled to statutory interest for delays in commercial transactions.
§ 4. PERFORMANCE OF SERVICES AND DELIVERY
- Lead times specified in offers are estimates unless the parties have explicitly agreed on a fixed "time is of the essence" deadline.
- For services performed at the Customer's site, the Customer is obliged to:
- Provide unobstructed access to fire protection devices and necessary premises.
- Provide relevant technical documentation of the facility.
- Ensure safe working conditions for the Seller's technical personnel.
- If a service cannot be performed due to the Customer's fault (e.g., lack of access to the site at the agreed time), the Customer may be charged for travel costs and labor readiness.
- Risk of accidental loss or damage to goods passes to the Customer upon delivery or handover to a carrier.
§ 5. TRAINING SERVICES
- The Seller provides qualified instructors and training materials in accordance with the training program.
- Cancellation of training by the Customer must be submitted in writing. In the event of cancellation less than 3 business days before the scheduled date, the Seller reserves the right to retain 50% of the fee to cover organizational costs.
- The Seller reserves the right to reschedule training due to unforeseen circumstances (e.g., instructor's illness, insufficient group size), about which the participants will be notified immediately.
§ 6. COMPLAINTS, WARRANTY, AND LIABILITY
- The Seller grants a warranty for installation works for the period specified in the offer. Third-party goods are covered by the respective manufacturer's warranty.
- Complaints should be directed to kontakt@fire-protection.pl immediately upon discovery of a defect.
- Regarding Business Entities (B2B): Liability under the statutory warranty (rękojmia) is excluded pursuant to Art. 558 § 1 of the Civil Code. The Seller's total liability for damages is limited to the actual value of the specific order.
- The Seller is not liable for damages resulting from improper operation of systems by the Customer, lack of mandatory periodic inspections by authorized entities, or force majeure.
§ 7. PERSONAL DATA PROTECTION (GDPR)
- The Administrator of personal data is FIREPROTECT Sp. z o.o.
- Data is processed solely for the performance of the contract, issuance of accounting documents, and archiving purposes (pursuant to Art. 6 sec. 1 lit. b and c of the GDPR).
- Detailed information regarding data processing is available in the Privacy Policy on the Seller's website.
§ 8. FINAL PROVISIONS
- For matters not regulated herein, the provisions of the Polish Civil Code and the Consumer Rights Act shall apply.
- Any amendments to these Terms must be made in writing to be valid and shall be effective upon publication on the website.
- Any disputes arising from the performance of contracts shall be settled amicably. If no agreement is reached, the court competent for the Seller's registered office shall have jurisdiction over disputes with Business Entities.
